Esso^TM and Mobil^TM e-Gift Card Bonus Offer Terms and Conditions

This promotion is offered and fulfilled by UGO Mobile Solutions, a division of the Toronto Dominion Bank ("UGO," "we" or "us").

Offer Details:

This Esso^TM and Mobil^TM e-Gift Card Bonus Offer ("Offer") is available to individuals who, between November 24, 2022 and December 2, 2022 ("Campaign Period") become an Eligible Participant by meeting the conditions under "How to become an Eligible Participant" below. Subject to the terms and conditions herein, for every $100 Esso and Mobil e-Gift Card ("e-Gift Card") purchased during the Campaign Period by an Eligible Participant through a valid UGO Wallet account ("UGO Wallet Account"), that Eligible Participant will be eligible to receive a bonus $10 Esso and Mobil e-Gift Card ("Bonus e-Gift Card").

To be eligible for the Offer, Esso and Mobil e-Gift Card purchases must be in increments of $100. Esso and Mobil e-Gift Card purchases using other denominations will be not be eligible.

Eligible Participants may purchase through a UGO Wallet account any number of eligible e-Gift Cards up to a maximum total qualifying amount of $1000, with a resulting maximum aggregate total of $100 ("Maximum Bonus") in Bonus e-Gift Cards issued.

Maximum Bonus applies: (a) per Eligible Participant regardless of whether an individual owns more than one smartphone or has more than one UGO Wallet account; and (b) per valid UGO Wallet account regardless of whether multiple individuals have the ability to use the UGO Wallet account.

How to become an Eligible Participant:

To become an Eligible Participant, you must:

1) Have a valid UGO Wallet account; and

2) Purchase a minimum of one $100 e-Gift Card in the UGO Wallet app during the Campaign Period. For clarity, Esso and Mobil e-Gift Card purchases must be in increments of $100 to be eligible. Cumulative Esso and Mobil e-Gift Card purchases using other denominations will be not be eligible.

Fulfillment:

The Eligible Participant’s UGO Wallet Account will receive the Bonus Card(s) between November 29, 2022 and December 6, 2022.

Eligible Participant's Claim Obligation:

To be able to use the Bonus e-Gift Card, an Eligible Participant must claim the Bonus e-Gift Card by no later than December 31, 2022. A Bonus e-Gift Card that is not claimed by December 31, 2022 will automatically be removed from the Eligible Participant’s UGO Wallet Account and will not be retrievable. Eligible Participants must keep the UGO Wallet app on their smartphone until they have claimed the Bonus e-Gift Card. Once claimed, the Bonus e-Gift Card will not be removed by UGO from the UGO Wallet Account. No hard copy of the Bonus e-Gift Card will be provided.

General Terms:

UGO may, at its discretion, change, extend, limit, suspend, or withdraw this Offer at any time and without notice. This Offer is not assignable or transferable and may not be redeemed for cash.

UGO reserves the right to disqualify from participation in the Offer any individual who does not comply with these terms and conditions or who UGO suspects or has confirmed has committed fraud related to the Offer.

Use of an e-Gift Card or Bonus e-Gift Card is governed solely by the terms and conditions as provided by the issuing merchant of such e-Gift Card or Bonus e-Gift Card, generally available on the issuing merchant's website, as well as any terms and conditions that govern your use of UGO Wallet. For information on how to check the balance of the e-Gift card or Bonus e-Gift Card, please contact the issuing merchant or visit the issuing merchant's website. Eligible Participants are responsible for any applicable taxes or any costs or expenses associated with the use or redemption of the e-Gift Card or Bonus e-Gift Card.

Further, by becoming an Eligible Participant you release and discharge UGO, its affiliated companies, advertising agencies, fulfilment and promotional partners (including the issuing merchant), and their respective officers, directors, shareholders, employees, agents and subcontractors (collectively the “Released Parties”) from all liability or damages that may arise out of your participation in the Offer or your acceptance, use, inability to use, or misuse of a Bonus e-Gift Card.

The Released Parties are not responsible for and shall have no liability for any unavailability, interruption or failure of any computer, mobile device, software, hardware, network, telecommunications or internet provider, app, website or any other occurrence outside of the control of the Released Parties that in any way impacts or affects UGO’s ability to provide or fulfill the Offer.

Standard wireless data rates may apply to your acceptance and use of the e-Gift Card or Bonus e-Gift Card.

How to use your e-gift card

1. Present the barcode in-store to the attendant when making purchases at participating Esso™ and Mobil™ stations
2. Have the attendant scan the barcode and pay remaining balance where applicable
